These Terms of Use govern your access to and use of the Foodie Banter mobile application, website and related services, together referred to as Foodie Banter or the Service.
By creating an account or using Foodie Banter, you agree to these terms and our Privacy Policy. Please do not use the Service unless you agree to them.
What Foodie Banter does
Foodie Banter lets people privately share restaurant, café, bar and other place recommendations and reviews with friends they trust.
Foodie Banter is not a public ratings platform. Content is generally shared within connections made through the Service rather than published as a public, searchable review.
The Service is currently being provided as a beta. Features may be incomplete, change during testing or occasionally fail.
Beta access
Foodie Banter is invite-only during its beta period.
Access may require:
- an invitation from us or an existing user;
- installation through Apple TestFlight, Google Play testing or another distribution service; and
- creation of a Foodie Banter account.
We may limit the number of testers, pause new registrations or withdraw beta access at any time.
Beta access does not guarantee that Foodie Banter will be commercially released or that any particular feature will remain available.
Who may use Foodie Banter
You must be at least 18 years old to create an account or use Foodie Banter during the beta.
You must provide accurate information when creating your account and keep your account information reasonably up to date.
You may not create an account for someone else without their permission or impersonate another person or organisation.
Your account
You are responsible for activity carried out through your account and for keeping your sign-in details and devices reasonably secure.
Please tell us promptly at [email protected] if you believe someone has accessed your account without permission.
You must not sell, transfer or give your account to another person.
We may use email links, verification codes, Apple, Google or other authentication services to confirm your identity. Your use of those third-party services may also be governed by their own terms and privacy policies.
Connections and visibility
Foodie Banter is designed for sharing content with people you have connected with through the Service.
Before posting, you should check who will be able to see the content. Depending on the features available at the time, content may be visible to:
- your connected friends;
- people participating in a shared conversation or group;
- people you subsequently connect with; or
- our authorised personnel and service providers where reasonably necessary to operate, secure or support the Service.
Foodie Banter is private by design, but you should not treat anything you post as completely confidential. Other users may copy, screenshot, repeat or share information outside the Service without our permission.
Do not post information that would cause serious harm if another person shared it.
Your content
You retain ownership of reviews, ratings, comments, photographs and other material you submit to Foodie Banter, referred to as Your Content.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, resize, display and transmit Your Content solely as reasonably necessary to:
- provide Foodie Banter to you and the people with whom you share it;
- operate, maintain and improve the Service;
- make backups and protect the Service;
- investigate reported problems or misuse;
- comply with legal obligations.
This licence ends when Your Content is deleted from our active systems, except where continued storage is reasonably required for backups, security, dispute resolution or legal compliance.
You confirm that:
- you created Your Content or have permission to use and share it;
- Your Content does not infringe another person’s intellectual property, privacy or other rights;
- any review reflects your genuine experience and honestly held opinion;
- any factual claims you make are accurate to the best of your knowledge.
Photographs and personal information
Only upload photographs that you have taken or have permission to use.
Take particular care before uploading photographs containing identifiable people. You should normally obtain their permission, especially where a photograph was taken in a private setting or could reasonably cause embarrassment or harm.
Do not post another person’s private contact details, home address, financial information, health information or other sensitive personal information without a legitimate reason and their clear permission.
Acceptable use
You must not use Foodie Banter to:
- post content that is unlawful, threatening, harassing, abusive, hateful or deliberately misleading;
- defame another person or make allegations presented as fact without a reasonable basis;
- bully, intimidate or target another user, restaurant employee or business owner;
- post fake reviews or reviews in return for undisclosed payment, gifts or other incentives;
- manipulate recommendations, engagement or account activity;
- advertise or send unsolicited promotional messages;
- infringe copyright, trade marks, privacy or other rights;
- distribute malware or interfere with the security or operation of the Service;
- access another person’s account without permission;
- collect or scrape information from the Service using automated means;
- reverse engineer the Service except where applicable law expressly permits it;
- use the Service to develop, train or evaluate a competing service using data obtained from Foodie Banter; or
- use Foodie Banter for any unlawful or fraudulent purpose.
Reasonable criticism and negative reviews are permitted. Reviews do not have to be positive, but they must represent a genuine experience and should distinguish clearly between fact and opinion.
Restaurant and place information
Information about restaurants and other places may come from users or third-party data providers.
Names, locations, opening hours, menus, prices, accessibility information and other details can change or be incorrect. You should confirm important information directly with the relevant venue before travelling, making a booking or relying on it.
Foodie Banter does not operate, endorse or control the places reviewed through the Service.
Reviews are personal opinions submitted by users. They do not represent our views, and we do not guarantee that they are accurate, complete or suitable for your circumstances.
Food allergies and safety
Foodie Banter is not a source of medical, allergy or food-safety advice.
Information about ingredients, allergens, dietary suitability and food preparation may be incomplete or incorrect. Always discuss allergies and dietary requirements directly with the restaurant or venue.
Do not rely solely on Foodie Banter when making decisions that could affect your health or safety.
Reporting content or behaviour
You can report content, accounts or behaviour that you believe breaches these terms by using any reporting feature available in the Service or by emailing [email protected].
Please include enough information for us to identify and assess the issue.
We may investigate reports and take any action we reasonably consider appropriate. This may include:
- asking for further information;
- limiting the visibility of content;
- removing content;
- warning a user;
- restricting or suspending an account; or
- referring a matter to the appropriate authorities.
We are not required to resolve disputes between users, businesses or other third parties, although we may choose to assist.
Feedback and beta information
We welcome feedback, bug reports and suggestions about Foodie Banter.
You permit us to use feedback you voluntarily provide without payment or an obligation to implement it. This does not transfer ownership of Your Content or any intellectual property unrelated to the feedback.
Please do not disclose security vulnerabilities publicly. Send suspected security issues to [email protected] so that we have a reasonable opportunity to investigate them.
During the beta, we may ask you to keep unreleased features or information confidential where we clearly identify that information as confidential.
Our intellectual property
We or our licensors own Foodie Banter, including its software, design, branding, logos and other materials, except for Your Content and material owned by third parties.
We give you a personal, limited, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose while your account remains active and you comply with these terms.
These terms do not give you any ownership rights in Foodie Banter or permission to use our branding outside normal use of the Service.
Changes to the Service
Because Foodie Banter is in beta, we may add, remove or change features, interfaces, eligibility requirements and technical systems.
We may also temporarily suspend the Service for maintenance, security, technical or operational reasons.
Where reasonably possible, we will try to avoid changes that unnecessarily disadvantage users and will provide notice of significant changes.
Disclaimers
The service is provided "as is" during beta. We do not guarantee uninterrupted availability, perfect accuracy of place data, or that the app will meet your expectations. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent allowed by law, Foodie Banter and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim related to the service will not exceed the amount you paid us to use it in the twelve months before the claim (which is currently £0 during the free beta).
Suspension and termination
You may stop using Foodie Banter at any time.
You may request deletion of your account through the app, where that feature is available, or by contacting [email protected].
We may restrict, suspend or terminate your access where we reasonably believe that:
- you have seriously or repeatedly breached these terms;
- your account creates a security, legal or safety risk;
- we are required to do so by law;
- your activity may harm other users, us or a third party; or
- continuing to provide the Service is no longer reasonably practicable.
Where appropriate, we will try to explain our decision and give you a reasonable opportunity to respond. We may act immediately where necessary to protect users, investigate fraud or security incidents, comply with the law or prevent serious harm.
We may also end the beta programme or discontinue Foodie Banter. Where reasonably possible, we will provide advance notice.
Changes
We may update these terms as the beta evolves. We will change the "Last updated" date at the top when we do. Continued use of the Service after changes means you accept the updated terms.
Foodie Banter is currently provided to beta testers without charge.
We will not introduce a charge for your use of the Service without clearly informing you beforehand and obtaining any agreement required by law.
